On Tuesday, February 23, at 8:00 am the SD Senate Judiciary committee will take on 3 bills. This is compiled using the agenda at the time of composing this post. Agendas can and do change!

*** Wednesday is crossover day. That means this is the last day this committee has to get any Senate bills out to the floor!
It should also be noted that I have 4 bills listed before, but only mention 3 in the title of this bill. While watching the Senate proceedings today I noticed SB 89 was noted as withdrawn. That means it can no longer be heard. However since it is on the agenda I am including it in the contents of this post.
SB 168 (SoDakLiberty Posts) – Revise provisions related to human trafficking and to provide a penalty therefor.
SoDakLiberty Stance: Undecided
Prime Sponsors: Sen Ried Holien (R, Dist 5) and Rep Scott Craig (R, Dist 33) are the prime sponsors.
This makes a few changes.
First, it seems to outlaw someone who receives a person who “will be used to cause the person to engage in prostitution, forced labor, or involuntary servitude”. That is in addition to these actions already in in statute: recruit, harbor, transport, provide, or obtain.
Second it makes it a Class 2 felony when the victim is under 18, currently it is a Class 2 felony if the victim is under 16.
Finally it woudl add these two new laws:
Section 3. That chapter 22-49 be amended by adding a NEW SECTION to read:It is a Class 6 felony for a person to hire or attempt to hire another person for a fee to engage in sexual activity, as defined in § 22-23-1.1, if the person knew or should have known the other person was being forced to engage in the activity through human trafficking.Section 4. That chapter 22-49 be amended by adding a NEW SECTION to read:Each abortion facility, as defined in subdivision 34-23A-1(1A), and each adult theater, as defined in subdivision 11-12-1(7), shall prominently post a sign that includes the name and the telephone number of the National Human Trafficking Resource Center.
SB 163 (SoDakLiberty Posts) – Require the disclosure of certain cumulative contracts with the state.
SoDakLiberty Stance: Undecided
Prime Sponsors: Sen Scott Parsley (D, Dist 8) and Rep Paula Hawks (D, Dist 9) are the prime sponsors.
This modifies the statute titled “Bureau of Administration to serve as state’s central procurement agency”, § 5-18A-34. Here is what would be added to that statute:
If one or more procurement agencies enter into contracts with a person that cumulatively exceed fifty thousand dollars, the bureau shall post the name of the contractors and the subject and value of the contracts on the bureau’s website.
That seems like a good way to know if there is anything fishy is going on.
SB 169 (SoDakLiberty Posts) – Revise provisions related to child pornography and to revise the penalty therefor.
SoDakLiberty Stance: Undecided
Prime Sponsors: Sen Ried Holien (R, Dist 5) and Rep Scott Craig (R, Dist 33) are the prime sponsors.
Section 1 of the bill would change the sale of child porn from a Class 6 Felony to a Class 4 Felony.
Section 2 adds “or any other electronic” means to the portion where it is talking about computer transfers of child porn.
SB 89 (SoDakLiberty Posts) – Revise certain provisions related to permits to carry a concealed pistol.
SoDakLiberty Stance: Undecided
Prime Sponsors: Sen Corey Brown (R, Dist 23) and Rep Thomas Brunner (R, Dist 29) are the prime sponsors.
This bill seemed aimed at restoring rights to felons for a temp permit after rights have been restored.
